Terms of Use )zsis-Platform (AGBs)

These Terms of Use govern the relationship between you as a user of the Platform zsis) and us, the Institute for Swiss and International Tax Law (ISIS) as provider of various digital contents relating to tax law ("Platform Content"). They are also the general terms and conditions between ISIS and you, who agree to them by using the platform. If this does not apply, please refrain from accessing our offers. If you are also the author of platform content, the corresponding agreement with ISIS takes precedence in the event of contradictions.

1. Data Protection

You can find out how we handle your personal data on our privacy policy.

2. Retrieving/Receiving/Acquiring Platform Content

Via zsis) you can obtain free or paid platform content as a guest or registered user. The copyright to the Platform Content remains with ISIS, a licensor or licenser.

2.1 Free platform content

The retrieval or purchase of free platform content can be done by generating a PDF file that you can save on your computer, for example.

As a user, you undertake, in particular in the event of further distribution of the corresponding file and content, zsisnot to remove or conceal (for example, by reformatting) a note automatically attached in this connection and the link to the original source, even after a printout on paper.

2.2 Platform content subject to charges

zsis) grants you a non-exclusive or exclusive, non-sublicensable or transferable right to use the Platform Content, which is limited in time and personally to you, and which is non-terminable during the period of use. Video streams are available for a period of six months (from the date of purchase). Access to it is no longer possible after this period. Further conditions for the right of use can also be found in the corresponding offer.

Documents that can be downloaded for a fee, such as PDF documents, PowerPoint presentations, Word documents or similar, are available in a six-month download window (from the time of purchase of the documents). In this window, the user can download a maximum of three electronic copies of this data. Access is no longer possible after this period.

The relevant contract is concluded upon confirmation of the (credit card) payment made or access to the platform content subject to charges, usually via the provision of a streaming link. All payments (including applicable taxes, in particular value added tax) must be made in Swiss francs. Any fees for access to digital offers via your PC or one of your mobile devices are entirely at your expense.

With the purchase of paid content, the buyer agrees that his e-mail address may be used by the Institute for Swiss and International Tax Law (ISIS) for advertising purposes.

3. User-Generated Contributions

3.1 Contributions created by you

As an interactive platform, we offer you the opportunity to exchange information with us and other users (for example, by submitting comments). Please note that we do not regularly check such contributions for their content. We reserve the right to delete or change your contributions at our discretion.

In any case, contributions which

  • are obscene, racist, homophobic or sexist or any other form of hate speech
  • violate the copyrights of third parties;
  • are libellous, defamatory, otherwise unlawful or immoral, or may constitute a criminal offence

You are obliged to indemnify us in full against all claims of third parties which are asserted against us on the basis of your contributions (including any legal costs and court costs) and bear sole responsibility for any legal consequences of your contributions.

4. General Information

4.1. User Account

If you register on zsis) as a user and enter your name and/or e-mail address, you are obliged to protect your access data (including password) from unauthorised access by third parties and to treat them confidentially and not to pass them on to anyone. Any loss, theft or unauthorised use of your access data (password, user name, email address etc.) must be reported to us immediately upon becoming aware of this. In the event of violations such as multiple use of the user account, we reserve the right to block your access at any time without any further obligations on our part and to delete your user account.

4.2 Copyright to zsis)

The platform zsis) and all its contents are protected by copyright. Any use or exploitation outside of our offers is not permitted without prior written permission from ISIS or other written agreements, such as with an author. Neither the entire content nor parts thereof may be reproduced in any form - including all technical and digital processes. This prohibition includes in particular the reproduction, translation, storage and processing in electronic databases.

4.3 Warranty/liability

The platform content provided by ISIS was designed to the best of our knowledge and belief at the time of creation. However, neither ISIS nor the author assume any liability for the correctness of the platform contents or contributions or that no rights of third parties could be infringed.

Even though we are committed to ensuring the high quality, care and availability of our platform, we cannot exclude temporary restrictions and outages (business interruptions, troubleshooting, maintenance work, etc.). Your access and use of the platform contents and contributions is at your own risk. Any warranty with regard to the contents called up is therefore expressly excluded.

Furthermore, our liability for services provided by third parties and auxiliary persons is excluded. This applies to links to contents and offers of third parties, for whose legality, correctness, completeness and availability we do not assume any responsibility or liability. We are also not liable for damage caused by computer viruses and other harmful computer programs such as malware or spyware.

Our liability is in any case limited to intentional or grossly negligent breaches of contractual and non-contractual obligations for which we are responsible and which have been proven to us. Our liability for consequential damages and loss of profit is excluded.

4.4 Changes to these terms of use

We reserve the right and, if necessary, are also obliged to change the provisions of these terms of use. Such changes will be published by us without delay. It is your responsibility to regularly inform yourself about the currently valid terms of use

4.5 Applicable law and place of jurisdiction

All disputes arising out of or in connection with zsis) shall be governed exclusively by Swiss law, excluding the conflict of laws provisions and excluding the UN Convention on the International Sale of Goods (CISG).

Place of performance and exclusive place of jurisdiction is Zurich.

As a legal basis for the processing of your personal data, we regularly use this data:

5. recipient of personal data

If personal data is processed by external order processors, we ensure that the legal requirements are met. A transfer to third parties only takes place if this is necessary for the execution of the contract with you, if the transfer is permitted on the basis of a weighing of interests, if we are legally obliged to transfer the data or if you have given your consent. However, your data will never be resold.

We process personal data only as long as this is necessary for the respective purpose.

9. Data security

We take technical and organizational security measures to protect your personal data against manipulation, loss, destruction or access by unauthorized persons. The measures taken are intended to ensure the confidentiality and integrity of your personal data as well as the availability and resilience of our systems and services when processing your personal data in the long term. They also ensure the rapid restoration of the availability of your personal data and access to them in the event of a physical or technical incident.

Our security measures also include encryption of your personal data. All information that you enter online is transmitted via an encrypted transmission path. This means that this information should not be accessible to unauthorised third parties at any time.

Our security measures are continuously improved in line with technological developments.

The processing of this data is carried out by our web hosting provider Webflow, Inc. (398 11th Street, 2nd Floor, San Francisco, CA 94103) and for the purpose of enabling the use of our website (connection establishment, display of non-personalised advertisements and administration of our contact and feedback forms), to ensure system security and stability on a permanent basis, to optimise our offer and for internal statistical purposes and thus on the basis of our legitimate interests. A personal user profile is not created.

12th Newsletter

You have the possibility to subscribe to our newsletter via our platform. With the newsletter we keep you informed about us and our offers. By measuring the opening and click rates, we learn to better understand what interests you. The mandatory data (*mandatory) are necessary to send you the newsletter. The voluntary communication of further data enables us to provide you with even more targeted information.

For sending the newsletter and for evaluation we use the services of MailerLite, a newsletter sending platform provided by UAB "Mailerlite". The e-mail addresses of our newsletter recipients are stored on MailerLite's servers in Lithuania. MailerLite uses this information to send and evaluate the newsletters on our behalf.

13. retrieval/reference/acquisition of platform content

You have the choice of whether you only need to enter the necessary data once for this order ("Order without account") or whether you want to create a user account ("Register"), where your personal data will be stored for later purchases. On the user account you can, among other things, view data about the content you have already received or manage your personal data. In both cases, the mandatory information (*mandatory) is required, the others are optional.

If you would like to close your user account, please send us an e-mail to hello@zsis.ch. It is up to you to save your personal data in case of termination before the end of the contract. We are entitled to irretrievably delete all data stored during the term of the contract.

Within the framework of order processing, the payment service providers we use receive the necessary data for order and order processing. This is PayPal (Europe) S.à.r.l. et Cie S.C.A. Google uses cookies. The cookies used by Google enable us to analyse the use of our website. The information generated by the cookie about your use of our website (including your IP address) is transmitted to a Google server in Ireland or the USA and stored there.

a) Google Analytics

We use the web analysis service of Google Analytics for the purpose of demand-oriented design and continuous optimization.

In this context, pseudonymised user profiles are created and cookies are used to evaluate the use of our website, to compile reports on website activities and to provide further services associated with website and Internet use. This information may also be passed on to third parties where required by law or where third parties process this data on our behalf. However, according to information provided by Google, your IP address will not be merged with other data from Google.

We only use Google Analytics with activated IP anonymisation. As a result, your IP address will be shortened by Google within Switzerland or the EEA before transmission in the USA. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

You can prevent the storage of cookies by adjusting your browser software accordingly. However, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. b) Google Tag Manager

We use Google Tag Manager, a solution that allows us to manage web page tags through a single interface. The Google Tag Manager tool itself, which implements the tags, is a cookie-less domain and does not collect personal data. However, the tool will trigger other tags, which in turn may collect data. Google Tag Manager itself does not access this data. If deactivation has been made at the domain or cookie level, it will persist for all tracking tags implemented with Google Tag Manager.

If you visit our website and one of the plugins listed on the website is activated, a direct connection is established between your browser and the server of the social network concerned. The content of the plugin is transmitted directly from the social network to the browser and integrated into the website by the browser. In this way the network receives the information that you have visited our website. If you are logged into the social network, it can associate the visit with your account. When you interact with the plugins, the corresponding information is transmitted directly from the browser to the social network and stored there.

Even if you are not logged in to the social networks while visiting our website, data can be sent to the networks from websites with active social plugins. An active plugin sets a cookie with an identifier each time the website is accessed. Since your browser sends this cookie unsolicited every time you connect to a server of the respective networks, social networks could in principle use it to create a profile of which websites the user belonging to the identifier has visited. If necessary, it would then be possible to assign this identifier to a person again later - for example, when logging into the social network later on.

You can select the "Block third-party cookies" function in your browser settings, then your browser will not send cookies to the respective social network server. With this setting, however, other cross-site functions of other providers may no longer work, apart from the plugins.

16. social media presence

We maintain social media profiles on LinkedIn, Xing, Facebook and YouTube.

The data you enter on our social media profiles will be published by the social media platform and will not be used or processed by us at any time for other purposes. However, we reserve the right to delete content if this should be necessary and if it is possible for us to do so. At best, we communicate with you via the social media platform.

Be aware that the operator of the social media platform uses webtracking methods. The web tracking, which we have no influence on, can also take place regardless of whether you are logged in or registered on the social media platform.
